California Flat Fee for Sale by Owner (FSBO) or Attorney Closing Legal Assistance — full package for sellers/buyers includes legal documents, disclosures, and complete lender, escrow, and title coordination, legal advice, legal review and more.

We offer services that cater to the For Sale by Owner (FSBO) and individuals that want to control the majority of the home sale – limit liability and save a ton of money.  In short we can help you by providing legal assistance in the following:

  • Providing all contracts and disclosures to limit legal liability
  • Managing the sale process between buyer/seller/lender/escrow
  • Negotiating the highest price for your home sale with the best terms
  • Providing experience and expertise during the process so you close
  • Specific services for buyers or sellers

The largest investment most people have is their home.  Trying to sell a home alone can be extremely stressful and can open you up to tremendous legal liability if not done correctly or if the proper forms are not used.  We have designed a service to give you the legal assistance you need to take away the risk all while maximizing the money in your pocket!

For Sale by Owner (FSBO) Transactions

If you are selling a home on your own (FSBO) we can:

  • Assist you with negotiations with buyers and their agents.
  • Draft the purchase contract and draft and advise you on any counters or addenda required with the transaction.
  • Draft and advise you on the disclosures you are required to make to the buyer to make sure you are the best protected from any future lawsuits.
  • Ensure that your purchase and sale agreement terms properly protect your interests.
  • Review any title issues that may come up including any liens or judgments recorded to the property.
  • Represent you during negotiations with the buyer.
  • Facilitate the closing with the escrow company.
  • Communicate with and stay on top of the timelines for the buyer with their agent  (or with them directly)
  • Write legal demand letters if necessary

In a For Sale by Owner (FSBO) transaction you as the owner handle any repairs or inspections needed prior to putting the house on the market, the marketing and staging of your home, coordinating showings of your home with potential buyers, the holding of any open houses, the creation of brochures, professional pictures, and which websites you list it on.  All of this is available to be accomplished with our advice, guidance and list of recommended vendors if needed.

Be careful that if you list your home on any MLS listing service (you will get solicitations to do so from $99 on up to do so from companies once you list your home for sale), you are then contractually obligated to offer and pay at closing a commission to the buyer’s agent of typically 3%.  We are available to assist with the development and production of any marketing needs you may have for an additional fee if you should so choose.

I offer a full service legal package for sellers/buyers which includes legal contacts, including purchase agreements, negotiations, counter-offers, amendments, addendum, and required and necessary disclosures to make sure that the parties are adequately protected from liability. 

The package also includes full lender, escrow and title coordination including reviewing the preliminary title report, escrow instructions, closing statements and escrow amendments, working with escrow and staying on top of all contingency periods and timelines with the different parties to make sure the closing happens in a timely manner and in accordance with the contracts.  Lastly the package also includes legal advice regarding estate planning and how title to the property should be held.
